Prosper Health Academy Terms and Conditions

Effective 29 September 2026

1. About these Terms

These Terms apply to psycho-education courses, webinars, workshops, memberships, videos and learning resources supplied by Prosper Health Academy (PHA) through its Thinkific site and associated online platforms (the Offerings). PHA is operated by Prosper Health Academy Pty Ltd (ACN 682 351 079), which is responsible for supplying the Offerings and processing payments made directly to PHA. These Terms do not automatically govern a service delivered under a separate agreement with a school, employer or other organisation.

The Offerings are available only to people aged 18 years and over. By purchasing, enrolling in or using an Offering, you confirm that you are at least 18 years old.

The description and checkout information for each Offering set out its particular inclusions, price, access period, delivery arrangements and any additional conditions. If those details differ from these general Terms, the Offering-specific details apply to that Offering, subject to applicable law.

By purchasing, enrolling in or using an Offering, you agree to these Terms and acknowledge PHA's Privacy Policy. If you enrol another adult, you must have authority to do so and make these Terms available to them.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

2. What PHA provides

PHA's Offerings provide general education and psycho-education. They may include live online sessions, recorded teaching, activities, downloadable resources and other learning materials, as described for the particular Offering.

PHA may make reasonable changes to presenters, dates, topics or delivery arrangements when necessary and will notify affected participants of significant changes. If PHA cancels an Offering, or makes a change that means it can no longer be supplied substantially as described, you may choose a full refund or a transfer, as set out in section 5.

Unless an Offering expressly says otherwise, enrolment is for the named participant's personal educational use. An account, session link or paid place must not be shared with others, transferred or resold, except as permitted in section 5. If an Offering is expressly sold as a family, team or organisational licence, the stated licence conditions govern who may use it.

You are responsible for providing a compatible device, suitable internet connection and accurate contact details, and for keeping your login details secure. PHA uses Thinkific and may use Zoom, payment providers and other third-party services to deliver Offerings. Temporary interruption can occur because of maintenance, outages or circumstances beyond PHA's reasonable control. Contact PHA if a technical problem materially prevents access to a paid Offering.

3. Educational scope and professional support

Information in the Offerings is general and may not fit every person or situation. It is intended to help participants understand ideas and consider practical approaches; it is not individual psychological, medical or legal advice. Participation does not, by itself, establish a psychologist–client treatment relationship with a presenter or PHA.

Unless explicitly arranged under a separate service agreement, PHA's Offerings do not provide therapy or counselling, individual assessment or diagnosis, clinical recommendations for a particular person, case management or crisis support. You are responsible for deciding how to apply general information and for seeking individual advice from an appropriately qualified professional when needed.

PHA supplies its services with reasonable care and skill. Nothing here limits its responsibilities or your rights where the law does not permit that limitation.

4. Live sessions and participation

Where an Offering includes live sessions, its page or joining instructions will explain how to attend and whether separate registration is required.

PHA does not record live sessions, and live sessions are not available as replays. PHA may provide a separate summary or resource instead.

Session arrangements, including cameras, microphones, chat and questions, will be communicated for the particular Offering. Presenters may moderate, combine or decline questions for reasons of time, privacy, safety or professional scope.

Group discussion takes place only within live sessions. Please keep questions general and avoid sharing names, identifying details, health information or sensitive information about yourself or anyone else in session chat, discussion or forms. Participate from a suitably private place. PHA cannot guarantee the confidentiality of information you voluntarily disclose to other participants in a live session.

You must treat presenters and other participants respectfully and must not record a session or distribute its link, chat, slides or participant information without PHA's written permission. PHA may remove a participant from a session where reasonably necessary to protect others or allow the session to proceed.

5. Prices, payments, cancellations and refunds

Prices and payment. Prices are in Australian dollars. PHA is not currently registered for GST. If PHA becomes registered, prices will state whether GST is included. The price, payment schedule, access period and any trial or recurring-payment arrangements will be shown before enrolment in a paid Offering. A discount or promotional price applies only on the conditions stated in that offer. If a payment fails, PHA or its payment provider may contact you to update your payment details and may suspend access while an amount remains unpaid.

Default cancellation and refund policy. Unless the information for a particular Offering states different terms, the following applies:

If PHA cancels or changes an Offering. If PHA cancels or postpones a live session, or makes a change that means an Offering can no longer be supplied substantially as described, you may choose a full refund or a transfer to an alternative date or Offering.

Refunds are paid to the original payment method, usually within 10 business days of approval. Missing a live session or choosing not to use purchased materials does not, by itself, create a right to a refund.

Subscriptions and memberships. These renew automatically only where this is clearly stated before purchase. The checkout information will specify the renewal period, price or basis for pricing, and how to cancel. PHA will give advance notice of a renewal and any change to the renewal price. You may cancel future renewal using the available account controls or by contacting PHA before the renewal payment is processed. Cancellation normally leaves access in place until the end of the paid period. Trial terms, including any charge after the trial, will be stated at enrolment.

If you believe you have been charged incorrectly or an Offering has not been supplied as described, contact PHA. Your rights under the Australian Consumer Law apply in addition to this policy.

6. Materials and acceptable use

Unless stated otherwise, PHA owns or licenses the videos, presentations, downloads, written materials, branding and other content in its Offerings. Your enrolment gives you a limited, non-exclusive, non-transferable right to use those materials for the educational purposes and period stated for the Offering. Without PHA's prior written permission, you must not substantially copy, record, publish, distribute, resell, upload or present the materials as your own, or use them to deliver training or professional services. A separate organisational licence may grant wider use where expressly stated.

PHA may suspend or end access if you seriously or repeatedly breach these Terms, including through unauthorised sharing, infringement of others' rights, abusive conduct or interference with platform security. Where reasonably possible, PHA will explain the concern and give you an opportunity to address it. Immediate suspension may be necessary to protect safety, privacy or platform security. Any refund or remedy remains subject to applicable law.

7. Privacy and safety

PHA handles personal information in accordance with its Privacy Policy and applicable law. Thinkific, online meeting services and payment providers may process information necessary to deliver the relevant Offering. Please avoid submitting sensitive information or identifying information about another person through general enquiries, session chat, surveys or feedback forms. If a concern requires individual attention, contact an appropriate professional or service directly.

PHA's learning platform, email, chat, surveys and feedback forms are not continuously monitored and must not be used for emergencies. If PHA becomes aware of information suggesting a serious threat to someone's life, health or safety, it may take steps it reasonably considers appropriate, including contacting the person involved, emergency services or another appropriate service, in accordance with law and professional obligations. PHA cannot promise that it will see or be able to respond to every message.

If someone is in immediate danger in Australia, call 000. For urgent support, contact Lifeline on 13 11 14, Kids Helpline on 1800 55 1800, a local mental health crisis service, a GP or another appropriate health professional. Participants outside Australia should contact their local emergency or crisis service.

8. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded, restricted or modified.

Subject to that, and to the extent permitted by law:

9. Complaints and disputes

If you have a concern about an Offering, a payment or these Terms, please contact PHA using the details in section 12, including the email address associated with your Thinkific account and a description of the issue. PHA will acknowledge your complaint within 5 business days and aim to respond within 30 days.

PHA and you will try in good faith to resolve any dispute informally before taking other action. If a complaint is not resolved, you may contact Consumer Protection WA (www.consumerprotection.wa.gov.au) or seek other independent advice. Privacy complaints are handled under the Privacy Policy.

10. Changes to these Terms

PHA may update these Terms when reasonably necessary, for example to reflect changes in the law, its Offerings or its service providers. The current version will be available on the PHA Thinkific site and will show its effective date.

PHA will give reasonable notice of material changes affecting a current paid Offering. If a change materially disadvantages you in relation to a current paid Offering, you may cancel that Offering and receive a pro rata refund for the unused portion. Changes will not retrospectively remove rights already accrued.

11. Governing law

These Terms are governed by the laws in force in Western Australia and applicable Commonwealth laws. You and PHA submit to the non-exclusive jurisdiction of the courts of Western Australia.
