Effective 29 September 2026

This Privacy Policy explains how Prosper Health Academy collects, uses, stores and discloses personal information in connection with its offerings delivered through Thinkific. It also explains how you can access or correct your information, make a privacy complaint, or contact us about privacy.

1. About this policy

Prosper Health Academy (PHA, we, us or our) is operated by Prosper Health Academy Pty Ltd (ACN 682 351 079). PHA provides education and psycho-education offerings through Thinkific, including courses, memberships, live sessions, videos and resources. We are committed to handling personal information responsibly and in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and other applicable privacy requirements.

This policy applies to people who enquire about, register for, purchase, enrol in or use a PHA offering on Thinkific; attend a related live session; complete a related form or survey; or otherwise communicate with PHA about those offerings. A particular offering may have additional information about its own arrangements.

Our Thinkific offerings are intended only for adults aged 18 years and over. They are not designed for or directed at children, and we do not knowingly create accounts for people under 18. If we become aware that a person under 18 has created an account, we will take reasonable steps to close it and to delete or de-identify their personal information, unless we are required or permitted by law to retain it.

Our Thinkific offerings provide education and psycho-education. They are not psychological treatment, counselling, assessment or crisis-response services. Information held for these offerings is not ordinarily a clinical record. If you receive a separate clinical service from another provider, that provider's privacy arrangements apply to that service.

PHA is a separate organisation from Prosper Health Collective and is not related to it. PHA does not share participants' personal information with Prosper Health Collective.

2. Personal information we collect

Depending on how you interact with us and the offering, we may collect:

  • identity and contact information, such as your name, email address and any phone number you choose or are asked to provide;

  • enrolment and eligibility information, such as your role, organisation, school or family connection where relevant to an offering or price;

  • account and transaction information, such as your enrolments, membership or subscription status, renewals, purchases and payment history;

  • participation information, such as session registrations, attendance, course progress, survey responses, feedback and general questions submitted to PHA;

  • communications with us about access, payments, cancellations, privacy, safety or technical support; and

  • technical information collected through Thinkific, related providers and the analytics and marketing tools described in section 13, such as device, browser, login, cookie, usage and diagnostic information.

Payment card details are processed by the relevant payment provider. PHA may receive transaction details and payment status but does not ordinarily receive or store complete card details.

3. Sensitive and other people's information

PHA does not generally ask you to provide detailed health information or other sensitive information to participate in a Thinkific offering. Some optional questions or activities may invite reflections about personal experiences. Please avoid including identifying health or other sensitive details about yourself or another person unless we specifically explain why that information is needed and how it will be handled.

Do not include a child's name, school, health information or other identifying details in live-session questions, surveys, feedback forms or general support emails unless expressly requested for a stated purpose. If you provide information about another person, including a child, you should be authorised to do so and provide only what is reasonably necessary.

If we receive unsolicited personal or sensitive information, we will assess whether it may lawfully be retained and take reasonable steps to delete or de-identify it when it is not needed or permitted to be kept.

4. How we collect information

We usually collect personal information directly from you when you create an account, enrol or purchase, register for a live session, complete a form or survey, contact us, or use a Thinkific offering. Information may also come through providers used to deliver the offering, including Thinkific, video conferencing, payment and email service providers, and through the analytics and marketing tools described in section 13.

In limited circumstances, we may receive information from an organisation, school, partner or another person where you have authorised this, where it is necessary to administer an agreed access or enrolment arrangement, or where collection is otherwise required or permitted by law.

5. Dealing with us anonymously

Where it is lawful and practicable, you may deal with us anonymously or by using a pseudonym, for example when making a general enquiry. To create an account, enrol, make a purchase or attend a live session, we will need to identify you, as we cannot otherwise provide access, process payments or manage your enrolment.

6. Why we collect and use information

We collect and use personal information where reasonably necessary to:

  • create and manage accounts, enrolments, purchases and memberships;

  • confirm eligibility and apply an applicable offer or price;

  • process payments, renewals, cancellations and refunds;

  • deliver live sessions, courses, videos, resources and related services;

  • send access details, session information, updates and essential account or service communications;

  • respond to enquiries, feedback, complaints, technical issues and privacy requests;

  • understand participation and improve our offerings;

  • measure and improve the effectiveness of our marketing and advertising;

  • maintain security, prevent misuse and administer applicable terms and conditions;

  • respond to a serious safety concern where permitted by law; and

  • meet our legal, regulatory, insurance and professional obligations.

7. Live sessions and online features

PHA does not record live sessions. Please do not record, photograph or otherwise capture live sessions or other participants.

Information you share during a live session, such as your name, questions or chat messages, may be visible to the presenter and other attendees. Please share only what you are comfortable with others seeing, and follow the guidance in section 3 about sensitive information and information about other people.

Thinkific community and discussion features are not enabled for PHA offerings.

8. Feedback and testimonials

We use feedback and survey responses to understand participation and improve our offerings. We will only publish a testimonial, quote or comment that identifies you, including by name, image or other identifying details, with your consent. We may use feedback in de-identified form, provided it does not identify you or any other person.

9. Service and marketing communications

We may send communications needed to provide an offering you have registered for or purchased, including account and access details, payment and renewal notices, session information, relevant resources and service changes.

If we send promotional messages about PHA offerings, we will do so with the consent required by law and provide a clear way to unsubscribe. Unsubscribing from promotional messages will not prevent essential account, transaction or safety communications.

10. When we disclose personal information

We may disclose personal information where reasonably necessary to:

  • technology, video conferencing, payment, email, data storage and professional service providers that help us deliver our offerings;

  • analytics and advertising providers, as described in section 13;

  • PHA personnel, contractors and presenters who need the information to perform their role;

  • an organisation or partner involved in a particular offering, in the limited circumstances described in section 11;

  • a person or organisation that acquires, or proposes to acquire, all or part of PHA's business or assets, or as part of a restructure, subject to appropriate confidentiality and privacy protections;

  • regulators, courts, law enforcement agencies, emergency services or other bodies where disclosure is required or authorised by law; and

  • an appropriate health service, emergency service, school representative or other suitable person where disclosure is reasonably necessary to respond to a serious threat to a person's life, health or safety and is permitted by law.

We do not sell participants' personal information.

11. Partner and organisation arrangements

Some PHA offerings involve a school, employer, association or other partner. We may provide that organisation with aggregate or de-identified enrolment or participation information where relevant to the arrangement. We do not ordinarily share identifiable individual participation information with a partner or school unless we have told you about an applicable arrangement, you have consented, or disclosure is required or authorised by law, including where permitted to respond to a serious threat to life, health or safety.

If a particular offering is purchased or administered by an organisation, we may need to share limited information needed to manage access or fulfil that arrangement. Any specific reporting or sharing arrangements will be explained at enrolment or in the information for that offering.

12. Overseas processing and storage

Our Thinkific offerings use online providers, including Thinkific and, where relevant, video conferencing, payment, email, cloud, analytics and advertising providers. These providers may process or store personal information outside Australia, including in Canada and the United States, and in other countries in which they or their subprocessors operate.

Where Australian privacy law applies to an overseas disclosure, PHA will take reasonable steps required by law in relation to that disclosure. Privacy protections and legal requirements in another country may differ from those in Australia.

13. Cookies, analytics and marketing tools

Thinkific and other providers used for our offerings use cookies and similar technologies to enable logins, remember preferences, maintain security, diagnose technical problems and understand how their services are used.

PHA may also use analytics and marketing tools, such as tracking pixels, tags and cookies provided by analytics and advertising platforms (for example, Google and Meta). These tools may collect information such as the pages you visit, actions you take (such as viewing an offering or completing a purchase), your device and browser information, IP address and cookie identifiers. The providers may combine this with other information they hold and use it to help us measure our advertising and show you PHA advertising on other websites and platforms.

Because our offerings relate to emotional development and wellbeing, information about the pages you visit may indicate an interest in a particular topic. PHA does not send the content of your survey responses, form submissions or course activities to advertising platforms.

You can manage cookies through your browser settings, adjust your advertising preferences in your Google and Meta account settings, and opt out of Google Analytics using Google's browser add-on. Disabling some cookies may affect access or functionality.

14. Data quality, security and retention

PHA takes reasonable steps to keep personal information accurate, up to date and protected from misuse, interference, loss, unauthorised access, modification or disclosure. These steps may include access controls, secure accounts, reputable service providers, staff procedures and appropriate technical safeguards.

No online system can be guaranteed to be completely secure. If PHA becomes aware of a data breach, we will assess and respond to it in accordance with applicable law, including the Notifiable Data Breaches scheme where it applies.

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, to maintain appropriate business and transaction records, and to meet legal, insurance, tax and professional obligations. When information is no longer required, we take reasonable steps to delete or de-identify it, subject to lawful retention requirements and the operation of backup systems.

15. Access and correction

You may request access to personal information PHA holds about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details below. We may need to verify your identity before acting on a request.

We will respond to your request within 30 days. If an exception under applicable law permits us to refuse access or correction, we will explain the decision and available complaint options unless the law allows us not to do so. We will not charge for making a request. If a lawful charge applies to providing access, we will tell you in advance.

16. Privacy complaints

If you believe PHA has mishandled personal information, please contact us and describe your concern. We will acknowledge the complaint, investigate it and respond within 30 days.

If you are not satisfied with our response, or have not received a response within 30 days, you may lodge a complaint with the Office of the Australian Information Commissioner at www.oaic.gov.au or by calling 1300 363 992.

17. Changes to this policy

We may update this Privacy Policy when our practices, service providers or legal obligations change. The current version will be available through Thinkific or the PHA website and will show its effective date. If a change materially affects how we handle existing participants' personal information, we will take reasonable steps to notify affected people.
